Below are details of all ongoing applications which are subject to public consultation.

Members of the public who wish to submit a representation in regards to a Premises Licence or Club Premises Certificate application need to be aware their personal details will be made available to the applicant.  If this is an issue they may contact a local representative such as a ward, parish or town Councillor or any other locally recognised body such as a residents association about submitting the representation.

The Council is not able to accept anonymous representations. Representations must include your full name, address and contact information (telephone number, email address).

‘Relevant representations’ are representations:

  • about the likely effect of the premises licence on the promotion of the licensing objectives;
  • which have not been withdrawn and are not, in the opinion of the Council, frivolous or vexatious.

The four licensing objectives are:

  • The prevention of crime and disorder
  • Public safety
  • The prevention of public nuisance
  • The protection of children from harm

Any issues which fall outside of the licensing objectives will not be considered relevant.

For example:

A person wants to use a premises to open a convenience store selling groceries, newspapers and general household items. They would also like to be able to sell alcohol so they apply for the appropriate licence.

During the consultation period, a nearby resident objects to the application stating ‘’the premises are on a busy road and the opening of a new shop will increase the amount of traffic passing my property which will mean it takes me longer to get my car off my driveway’’.

This is not a relevant representation because traffic is not a licensing objective and even if the licence application was refused, the premises could still operate as a convenience store any potential increase in traffic would happen regardless of whether or not the premises was licensed for the sale of alcohol.

It is for delegated officers of the licensing authority to determine whether a representation is frivolous or vexatious.

Where relevant representations are received about an application the authority will hold a hearing to consider them unless the authority, the applicant and everyone who has made representations agree that the hearing is not necessary. 

Applicants and those making representations should seek, in advance of any hearing, to try to reach agreement or to narrow the areas in dispute, particularly where both are professionally represented.

We will ensure that all of the licensing objectives are met through the steps outlined below. Furthermore all of these steps will be monitored and reviewed regularly to ensure that these steps are effective, and that any necessary changes are implemented.

 

The prevention of crime and disorder

We will ensure this objective is met by making sure that all of the staff understand the social responsibility associated with the sale and supply of intoxicating liquids. In addition, measures will be taken to prevent the customer from consuming or carrying open containers of intoxicating liquid within the store premises. Furthermore, there will be sales policies including Proof of age (see " protection of children from harm" section below ). Also the sale of alcohol will be prohibited to customers who seem to be to intoxicated and or disorderly.

Additionally, we will ensure that all staff and employees are adequately trained that is complainant with the law. All such training will documented. Finally we will ensure that there is sufficient lighting that will discourage disorderly behaviour, with minimal impact on the neighbouring properties.

 

Public safety

We will meet the objective above using the following steps. We will not allow customers to carry open containers of alcohol within the store premises or right outside, additionally consuming such things will also not be allowed in the same manner.

Furthermore we will carry out regularly risk assessments for the premises and individuals.

Additionally, provisions of access for the emergency services are kept clear of any obstructions. Regular electrical and gas checks will be carried out. In addition, we will ensure that all staff are adequately trained in evacuation procedures, And that all the first aid equipment is readily available And that there is enough first aiders available. We will make sure that all pathways are kept clear and that sufficient lighting is in place.

 

The prevention of public nuisance

We will meet the following objective by ensuring that we control the sources of noise, such as refrigeration units, to our best abilities. Control the level of music inside the premises and as the opening time comes closer reduce the volume. In addition, there will be a zero tolerance policy towards people that are too disorderly and that are found to be too much of a nuisance. In addition, we will make adequate arrangements for any litter or waste to be disposed in an orderly manner and at times where it causes minimal disruption.

 

The protection of children from harm

We will achieve this objective through the following steps. We will train staff in accordance with the law in relation to consumption and intend to adopt Challenge 25 policy.

This store understands that in extending our opening hours we have a duty to the local community and that we continue to protect our staff and customers from danger and harm.

We believe that the systems we have in place are robust, thorough and will, as far as reasonably practicable, secure the promotion of the four licensing objectives. It should be noted that no Costa Coffee store within the United Kingdom serves alcohol (excluding airports).

We are eager to work in partnership with all responsible authorities to ensure the promotion of the four licensing objectives.

This store is keen to work in partnership with the local police service to prevent crime and disorder.

CCTV

Costa Coffee operates a robust CCTV Policy to ensure compliance with Data Protection Legislation and to assist the Police with the prevention and detection of crime. At all stores where CCTV is in operation appropriate signage reflecting this information is displayed.

Access to the CCTV system will be provided to Licence Authoriy/Police Officers at their request and in line with GDPR.

The premises shall install and maintain a CCTV system. A camera shall cover the hatch section for takeaway orders. The system shall continually record whilst the premises is open for licensable activities. All recordings shall be stored for a minimum period of 30 days with date and time stamping. Recordings shall be made available to the Police or an authorised officer of the Licensing Authority upon request throughout the preceding 30 day period, providing that such requests are in connection with the prevention or detection of crime.

A staff member from the premises who is fully conversant with the operation of the CCTV system shall be on the premises at all times when the premises are open to the public. This staff member shall be able to show the Police or an authorised officer of the Licensing Authority data or footage upon request.

The premises shall keep a suitable store of necessary recording media (such as DVD's, SD cards or similar) to enable footage to be recorded from the CCTV system and provided to the Police or an authorised officer of the Licensing Authority upon demand.

All faults with the CCTV system shall be repaired as soon as possible and in any case within three working days after which time, if the system is still inoperative no licensable activities shall take place without the agreement of the Watford Police Licensing Unit and the Licensing Authority until the fault is rectified.

Notices shall be prominently displayed at all exits requesting patrons to respect the needs of local residents and leave the area quietly.

No alcohol to be sold at this premises.

An Incident Log shall be kept at the premises for at least 12 months, and made available on request to the Police or an authorised officer of the Licensing Authority, which will record the following:

(e) seizures of drugs or offensive weapons

Costa has all necessary safety systems and procedures in place to protect the safety of our customers and team members. These safety systems and procedures are supported by mandatory safety training for all our team members.

All Costa stores are subject to regular safety inspections and checks, including a third-party safety audit.

Costa has an inhouse Safety & Security team that provides competent safety advice to all our outlets and works with our Primary Authority and other relevant authorities to ensure public safety.

d) The prevention of public nuisance

Litter

We are committed to keeping the areas around our stores clean and tidy, with litter picking built into our standard store operations. Our first goal is to prevent litter from occurring, for example by encouraging customers to use reuseable cups or offering crockery for drink-in customers.

Our loyalty programme encourages our customers to use their own re-usable cup by offering two beans per drink purchased and a free drink when 10 beans have been collected. However, we know that litter can occur, even when waste and recycling points are offered.

That is why over the last few years we have collaborated with a range of stakeholders on litter prevention, encouraging responsible disposal of packaging, cup recycling, and the use of reusable alternatives. We also encourage our team members to support litter picks.

Noise

Where it is practical to do so we are content to put measures in place to limit noise. All Costa Coffee store doors are self- closing and we try to encourage our customers to be considerate to our neighbours.

McDonald's operates a robust CCTV Policy to ensure compliance with Data Protection Legislation and to assist the Police with the prevention and detection of crime.  At all stores where CCTV is in operation appropriate signage reflecting this information is displayed.

McDonald's operate digital motion activated CCTV systems where images are retained on a hard drive system.  All CCTV equipment is of a standard suitable to record images of a proper quality, it meets the industry standard and has LGC Forensics or Kalagate Certification.  As part of the digital system an alarm will sound if the equipment is faulty or not recording, thereby alerting management for the need to intervene.  The CCTV system is regularly serviced by qualified maintenance technicians.

Access to the CCTV system will be provided to Police Officers at their request where reasonable.

Staffsafe

A Staffsafe™ system with both audio and visual monitoring capability will be installed in the restaurant, this system, can be

activated by either fixed or mobile panic buttons. Once activated the system links the restaurant to an external monitoring centre capable of intervening to resolve crime and disorder issues and/or provide the appropriate advice or instruction to support and protect the restaurant's staff and customers.

At this restaurant all shift managers have safety and security training; including Maybo SIA accredited Conflict Management Training.

  1. c) Public safety

This restaurant is keen to work in partnership with the local Fire Service and Environmental Health Officer to ensure public safety.

This restaurant has safety systems in place to protect the safety of customers and staff at all times (such as Staffsafe). We work with the local Environmental Health Office and local Fire Service to ensure we are complying, as far as reasonably practicable, with relevant Health and Safety and Fire Safety Legislation. This restaurant is also subject to inspections from our own safety and security teams to ensure our systems are being maintained.

All of our restaurant staff receive comprehensive safety training to ensure that safe working methods are adopted and all staff are trained on the restaurant's evacuation procedure in the event of a fire or other dangerous occurrence.

The conditions applied with the granting of this licence are as follows:-

  1. CCTV will be provided in the form of a recordable system, capable of providing pictures of EVIDENTIAL QUALITY in all lighting conditions particularly regarding facial recognition.

Cameras shall encompass all ingress and egress to the premises, fire exits, outside areas, and all areas where the sale/ supply

of alcohol occurs.

Equipment must be maintained in good working order, be correctly time and date stamped, recordings MUST be kept in date order, numbered sequentially and kept for a period of 31 days.

The Premises Licence Holder must ensure at all times a DPS or appointed member of staff is capable and competent at

downloading CCTV footage in recordable media format, and able to produce it to a Police Officer and/or an authorised Local Authority/Council Trading Standards Officer on demand and in a viewable format.

The CCTV equipment shall be kept in a secure environment under the control of the DPS or other responsible named

individual.

An operational weekly log report must be maintained endorsed by signature, indicating the system has been checked and is compliant, in the event of any failings actions taken are to be recorded.

In the event of technical failure of the CCTV equipment the Premises Licence holder/DPS must report the failure to the

Police (on contact number '101') and Council Licensing Department immediately.

  1. An incident log must be kept at the premises. Incident log records will be retained for a period of 12 months from the date it occurred. It will be made immediately available on request to an 'authorised person' (as defined by Section 13 of the Licensing Act 2003), an authorised Trading Standards Officer or the Police, and must record the following:

(a) all crimes reported to the premises (where relevant to the licensing objectives)

(b) all ejections of patrons

(c) any complaints received (where relevant to the licensing objectives)

(d) any incidents of disorder

(e) any refusal of the sale of alcohol

(f) any visit by a relevant authority or emergency services, noting time, date & purpose and those officials by name.

  1. The Premises shall maintain active membership and participation in any Business Crime Initiative supported by South Yorkshire Police covering the locality whilst such a scheme shall be in existence. Active membership means attendance at 75% of any and all Watch Meetings per annum, and participation includes any Radio Link scheme similarly supported by the local Crime and Safety Partnership.
  2. The Premises Licence Holder shall have a procedure in place to ensure that the Exit is checked regularly and clear of obstructions at all times.
  3. The staff will ensure that the customer area will be free of trip hazards and spillages at all times.
  4. Noise or vibration shall not emanate from the premises so as to cause a nuisance.
  5. If the general public congregating outside the premises are causing anti-social behaviour, the management shall request that they leave, and if the problem persists the Police shall be called to support.
  6. Prominent, clear and legible signage (in not less than 32 font bold) shall be displayed at all exits to the premises requesting the public to respect the needs of local residents and to leave the premises quietly
  7. The premises shall operate a Challenge 25 Policy. Such policy shall be written down and kept at the premises. The policy shall be produced on demand of the Police or an 'authorised person' (as defined by Section 13 of the Licensing Act 2003) or an authorised Trading Standards Officer the Local Authority/Council. Prominent, clear and legible signage (in not less than 32 font bold) shall also be displayed at all entrances to the premises as well as at, at least one location behind any counter advertising the scheme operated.
  8. A written register of Refusals will be kept including a description of the people who have been unable to provide required identification to prove their age. Such records shall be kept for a period of 12 months and will be collected by the Designated Premises Supervisor and produced to the police or an 'authorised person' (as defined by Section 13 of the Licensing Act 2003) or an authorised Trading Standards Officer the Local Authority/Council on demand.
  9. All staff engaged in the sale of alcohol to be trained in responsible alcohol retailing to the minimum standard of BIIAB level 1 or any equivalent training course within 1 month of commencing employment at the premises. No person shall be authorised to sell or supply alcohol until this training is completed. Refresher training will be conducted at 12 monthly intervals.  Training records shall be kept on the premises and produced to the police or an 'authorised person' (as defined by Section 13 of the Licensing Act 2003) or an authorised Trading Standards Officer of the Local Authority/Council on demand.

We will ensure staff are fully trained in licensing laws and responsible alcohol sales, supported by Challenge 25, refusal logs, and clear signage. CCTV will be in operation, and the kiosk will be staffed at all times. Alcohol sampling (5ml) will be carried out responsibly in line with the Licensing Act 2003. No alcohol will be sold to be consumed on-site,and unaccompanied minors will not be permitted. Daily safety checks, incident logs, noise and waste management, and regular risk assessments will be in place to maintain a safe, compliant environment.

  1. b) The prevention of crime and disorder

Staff Training: All staff will be trained to recognize and prevent issues related to alcohol consumption, including refusing sales to intoxicated individuals and handling conflict situations. CCTV Installation: High-quality CCTV systems will

be installed to monitor the premises, providing 24-hour surveillance to deter and document any criminal activities.Refusal

Logs: A refusals log will be maintained to record any instances where alcohol sales are refused due to age concerns, intoxication, or disorderly behavior.Staffing Levels: Ensure appropriate staffing levels during peak hours to maintain control and oversight of the premises.

  1. c) Public safety

Capacity Management: Monitor and manage the number of customers to prevent overcrowding and ensure compliance with fire safety regulations. Clear Signage: Provide clear signage for emergency exits, first aid points, and safety procedures.Regular Risk Assessments: Conduct regular risk assessments to identify and mitigate potential hazards on-site. Incident Reporting: Implement a system for staff to report any incidents, accidents, or safety concerns immediately.

  1. d) The prevention of public nuisance

Challenge 25 Policy: Implement and enforce a Challenge 25 policy, ensuring that anyone appearing under 25 is asked to provide valid ID (passport, driving license, or PASS card) before alcohol is sold.Staff Training: Train staff in identifying fake IDs and on the legal requirements surrounding the sale of alcohol to minors. No Unaccompanied Minors: Enforce a policy prohibiting the sale of alcohol to unaccompanied minors and ensure that children are not allowed to loiter in the premises. Prominent Signage: Display clear signage informing customers of the Challenge 25 policy and restrictions on sales to minors. The conditions applied with the granting of this licence are as follows:-

  1. CCTV

1.1   The premises shall install and maintain a digital CCTV system

1.2 . The CCTV system shall have sufficient hard drive storage capacity to store a minimum of

31 days.

1.3 The CCTV system shall be capable of obtaining clear facial recognition images and a

clear head and shoulders image of every person entering or leaving the premises at each exit and entrance point.

1.4   A CCTV log will be completed on a weekly basis to record all elements of the CCTV System is maintained in good working order and recordings date and time stamped.

  1. All staff shall be trained in the operation of the CCTV system to ensure rapid data retrieval & downloads of footage can be provided to the Police & the Local Authority Officer upon reasonable request in accordance with the Data Protection Act.
  2. CCTV shall be continually recording during licensable hours

3.1  In the event of a failure of the CCTV system for any reason, a record of the failure will be recorded in the premises log and immediate steps will be made to rectify the problem.

  1. Incident / Refusals Register

4.1    An incident log must be kept at the premises. Log records will be retained for a period of

12 months from the date it occurred. It will be made immediately available on request to an 'authorised person' (as defined by section 13 of the Licensing Act 2003), an authorised trading standards officer or the police, and must record the following;

(a)    All crimes reported to the premises (where relevant to the licensing objectives)

(b)    Any incidents of disorder

  1. Psychoactive substances including Nitrous Oxide will not be sold or stored at the premise at any time
  2. ALL Spirits will be sold from behind the counter at all times. Any deliveries of alcohol must

be stored away from customer areas immediately on delivery.

  1. Roller shutters are in operation at the front of the premises and a security door at the rear.
  2. There will be a minimum of 2 Refusals Policy Notices on display at the premises at all times which includes clear warnings that street drinkers will be refused the sale of alcohol.
  3. Prominent, clear and legible signage shall be displayed at all exits to the premises requesting the public to respect the needs of local residents and to leave the premises and the area quickly and quietly. (Quiet Notice)
  4. All employees will be vigilant and monitor the area immediately outside the shop and will use their best endeavours to disperse groups of 3 or more persons that appear to be loitering outside the shop if they have been customers of the shop. In addition, all staff will report any anti-social behaviour or acts of crime to the police immediately and provide the police with any CCTV footage on request.
  5. Deliveries to the premises shall be conducted in a manner that will not cause a nuisance to the occupiers of any residential properties surrounding the delivery address and deliveries shall be made at a time that will not lead to any public nuisance.
  6. Notices of any current City of Doncaster council PSPO's shall be displayed at the premises at all times.
