What is the Tenancy Agreement?

This is the legal contract between you and Doncaster Metropolitan Borough Council. By signing it you agree to certain conditions that both you and the Council must keep to. The conditions are set out in your Tenancy Agreement. Read your Tenancy Agreement carefully and see Rights and Responsibilities below. The Tenancy Agreement makes you responsible for the behaviour
of all members of your household and anyone who visits your home.

What if I am a joint tenant?

Joint tenants are jointly and individually responsible under the Tenancy Agreement. This means you have equal rights and obligations. Each tenant is responsible for ensuring that rent and other charges are paid in full. Also, if there is a breach of the Tenancy Agreement, either tenant can be held fully responsible. What if the Council fails to carry out its duties?

You are welcome to contact your Area Housing Office to complain. In most cases problems are resolved quickly following an informal discussion. However, if matters are not sorted out you should follow our formal complaints procedure. See COMPLAINTS.

What if I break the Tenancy Agreement?

As a first step we will try to sort out the matter with you. If we are unable to do so, we may have to take legal action against you and you could be made to leave your home. We only do this as a last resort. See Breach of Tenancy below and Can I be made to leave my home? below. If you have trouble paying your rent, we will try to work out a reasonable arrangement with you and help you claim any benefits you are entitled to. See ARREARS.

Can I be made to leave my home?

Yes, but only if your tenancy has come to an end or if you breach your Tenancy Agreement, for example by harassing your neighbours. See ANTI-SOCIAL BEHAVIOUR. Only a court can force you to leave. We will always follow a clear procedure if we have to take formal action. See Breach of Tenancy below.

  1. appeal against decisions we make that you don't agree with. See COMPLAINTS
  2. exercise your legal rights. See TENANTS' RIGHTS
  3. live in the property without being unnecessarily interrupted by your landlord.

Breach of Tenancy

A breach of tenancy is the term used for when you break your Tenancy Agreement. The most common breaches are failure to pay rent; causing nuisance to, or harassing, neighbours or our staff; damaging the property; obtaining the tenancy by making false statements.

If you breach your Agreement you can be made to leave your home. We can give you support and advice or refer you to others who can help.

You will be given the opportunity to sort things out. However if you do not do so we will take legal action to make you leave your home. This involves following formal actions.

If we are granted a 'Possession Order':

  1. you will have to pay for the costs of going to court
  2. you will have to leave your home
  3. you will still have to pay your arrears
  4. you may be considered to be intentionally homeless, and so may not be re-housed by a council if you apply to them.
