What action can I take?

If you are frightened because of the offensive or abusive behaviour of a neighbour or visitor towards you, please get in touch with us. Contact your Area Housing Office. We will need a record of the problem so you should keep a diary of events. You may be asked to appear in court or we may arrange for a professional witness to appear on your behalf. You can also take legal action yourself, against the person. You will need to contact a solicitor.

What can the Council do to help?

Your Tenancy Agreement covers the behaviour of all members of the household, and any visitors. See Tenants' Responsibilities below. If a disagreement between neighbours can be shown to be a clear breach of their Tenancy Agreement we can take legal action against the offending tenant. This could result in that tenant losing their home See Breach of Tenancy in TENANCY AGREEMENT. We can also take action against other residents or visitors who are not our tenants by taking out an Injunction or an Anti-social Behaviour Order. See What We Will Do below.

Can I be re-housed?

We would try to sort out the problem without re-housing you. We will only re-house people in very exceptional circumstances. Contact your Area Housing Office.

What if I'm worried about a neighbour?

If you think a neighbour is having difficulties and is in need of help, we may be able to approach them and discuss their needs. We will treat whatever you tell us as confidential. Contact your Area Housing Office.

Tenants' Responsibilities

All our tenants have signed the Tenancy Agreement which states that they, members of their household, or visitors must not in any way cause nuisance, harass or intimidate any other tenant or neighbour including other members of their household or visitors.

Anti-social behaviour in the form of excessive and persistent noise, disturbance, or abusive or threatening behaviour constitutes a breach of your Tenancy Agreement.

What is Anti-social Behaviour?

Anti-Social Behaviour includes all types of behaviour that harm the quality of life and cause distress or alarm amongst residents in the local area. This may include threats, drug dealing, theft, vandalism and damage to property.

Nuisance includes persistent noise from music, dogs, car engines, etc which causes distress to others.

Harassment is the deliberate interference with the peace, comfort or safety of any person. Harassing anyone on grounds of race, colour, ethnic or national origin, religion, gender, marital status, age, sexual orientation or disability, can be a criminal offence. It includes incidents of graffiti, damage to property, abuse, threats and physical attacks.

What We Will Do

We will take action against any kind of anti-social behaviour in or around the areas where we own properties. We consider this a high priority but you should be aware that it can take time to follow the proper process to protect everyone's rights.

It is hoped that problems can be sorted out at a local level, however in cases where it has not been possible to solve the problem locally, the case may be passed to the Anti-social Behaviour Team for further investigation and evidence gathering.

The Anti-Social Behaviour Team will work with complainants, victims and witnesses to provide enough evidence to take further action. They may apply to the court for an injunction or an Anti-social Behaviour Order.

Anyone who has been evicted because of bad behaviour may be regarded as intentionally homeless. He or she may not be accepted on to the waiting list of any council because they are not obliged to re-house him or her.
