There are a number of laws which are used by Doncaster Council to control air pollution.
Clean Air Act 1993
The whole of Doncaster Borough is smoke controlled which means:
- It is an offence to burn coal in a smoke control area except on certain approved appliances designed to burn certain grades of coal smokelessly.
- It is an offence to deliver coal to a domestic property in a smoke control area (except for an appliance as described above).
- It is an offence to emit dark smoke from a commercial premises.
The maximum fine for 1 and 2 is £1000 and the maximum fine for 3 is £20,000.
Environmental Protection Act 1990
This is a nine part Act which covers a range of environmental issues. Part 1 relates to the control of air pollution by local authorities, it basically empowered the Secretary of State for the Environment to make regulations in respect of the control of emissions to the environment
Environment Act 1995 & The National Air Quality Strategy
Under part IV of this Act the local authority must periodically review the air quality within its area.
The act enabled the production of the National Air Quality Strategy (NAQS). The NAQS has been operational since the 1 st . April 1997 and was revised in January 2000, giving rise to more stringent air quality objectives.
The strategy identifies pollutants including sulphur dioxide, carbon monoxide and particulate matter (PM10) which have to meet certain specific objectives by the years 2003 - 2005. These objectives are based upon pollutant concentrations, relating to their health effects.
Local Authorities must undertake a review and assessment of the air quality in their district in order to identify those areas at the local level where the national policies and instruments appear unlikely, of themselves, to deliver the national air quality standards by 2005.
