What Can I Do if I Have Been Refused Planning Permission?

The first course of action should be to contact the case officer and find out the reasons for refusal, the question then to ask yourself is; whether the application could be amended to overcome those reasons? Please speak to the case officer about your ideas and they will help you gauge if the changes you propose would make the application more acceptable.  If this is the case, you can then submit one other application of the same nature covering the same site with amended plans, free of charge. Such an application must be made within twelve months of the date of refusal.

You may be in the situation that the case officer does not believe the reason for refusal can be overcome and regardless of the ideas you propose it would be refused again.  This gives you two options available, do not continue to try and get planning permission for what you propose, or please read the paragraph below.

Alternatively, if your application is refused permission you may appeal against the decision. To make an appeal, you should visit The Planning Inspectorate website to download the correct appeal forms, or write to them and they can send you an appeal form to complete. It should be stressed that this should be used as a last resort as the process usually takes a minimum of 14 weeks from the start date of the appeal, and many appeals in 2006/07 have taken around 26 weeks to complete.
