The Council has the power to decide if it is appropriate to take Enforcement action or not, and, if so, which type of Notice may be appropriate in each case. Planning guidance is given on these matters and takes account of matters of public amenity and protection in the public interest.
Should an offender refuse to comply with the requirements of a formal legal notice, a prosecution may be pursued through the Courts.
There are rights to lodge an appeal against the service of certain notices and this can often mean delays in matters being resolved. Such delays are outside our control but we will keep you informed throughout.
