Landlord and Tenant Responsibilities

Doncaster Council recognises and values the role that private sector landlords play in meeting housing needs in the area.  We work in partnership with landlords to ensure they are informed and acquainted with housing legislation and good practice. 
 
Information focuses on regulations relating to setting up a tenancy, repairs and safety of residents.  We also work with landlords to ensure that these are applied and to improve the condition of housing and its management in the Borough.  We make tenants aware of their rights and responsibilities.

Ending a Tenancy, Harassment and Illegal Eviction

Ending a tenancy can be complex due to the types of tenancies and different grounds.  If this is done incorrectly it can be successfully challenged.  Furthermore, illegal eviction is a criminal offence which can lead to a fine and/or imprisonment.  We provide guidelines on the process for landlords and tenants and advise that landlords take independent legal advice through a solicitor or a national landlord’s body.

Rented Housing Standards

The Housing Health and Safety Rating System was introduced by the Housing Act 2004 replacing the previous ‘fitness standard’ for residential properties. It provides a system to enable potential hazards to be assessed within a property.

Statutory rules on overcrowding are outlined and the decent homes standard. This standard has been adopted in public sector housing and Council’s are encouraged to use it to raise all housing standards.

Tenancies

Information is available on finding and setting up a new home in the area and different types of tenancies.  It is recognised however, that most new private tenancies are let on a fixed term Assured Shorthold Tenancy.
